Consent Checkboxes on Forms: Getting Permission Properly

How to collect clear consent on enquiry and sign-up forms for calls, WhatsApp and email marketing, in line with Indian rules.

    When people submit a form, they agree to be contacted about their enquiry. Sending them marketing messages afterwards needs clear permission.

    Two different purposes

    • Responding to the enquiry: calling or messaging about what they asked.
    • Marketing: offers, newsletters, broadcasts.

    Good practice

    • A short notice near the button: “We will use your details to respond to your enquiry. See our privacy policy.”
    • A separate, unticked checkbox for marketing: “Send me offers and updates on WhatsApp and email.”
    • Name the channels you will use.
    • Link to your privacy policy; draft one with our privacy policy generator.

    Avoid

    • Pre-ticked marketing boxes.
    • Making marketing consent compulsory to submit an enquiry.
    • Hiding consent in long terms.

    Store when and how each person gave consent, and make it easy to withdraw.
