When people submit a form, they agree to be contacted about their enquiry. Sending them marketing messages afterwards needs clear permission.
This is general information, not legal advice. Check current requirements under India’s DPDP Act and other applicable rules.
Two different purposes
- Responding to the enquiry: calling or messaging about what they asked.
- Marketing: offers, newsletters, broadcasts.
Good practice
- A short notice near the button: “We will use your details to respond to your enquiry. See our privacy policy.”
- A separate, unticked checkbox for marketing: “Send me offers and updates on WhatsApp and email.”
- Name the channels you will use.
- Link to your privacy policy; draft one with our privacy policy generator.
Avoid
- Pre-ticked marketing boxes.
- Making marketing consent compulsory to submit an enquiry.
- Hiding consent in long terms.
Record consent
Store when and how each person gave consent, and make it easy to withdraw.
WhatsApp opt-in
WhatsApp’s business policies also require opt-in before you message people. Read sending bulk WhatsApp messages safely.
